"In Yonkers at 140 Market Street near Archer Street, I describe the Cheesecake Factory as the subject of a class-action lawsuit filed April 5 in the Southern District of New York by former employees Mirian Qquehue and Daniel Ramos alleging time shaving and other illegal labor practices dating back to 2011. I report that Qquehue (a cook who worked for the company in Westchester and Yonkers from 2011 to December 2021) and Ramos (a busser who began in Yonkers in December 2021) claim the employer should have paid weekly rather than bi-weekly because more than 25 percent of their work was physical, that the chain engaged in rounding down hours to pay employees less, and that Ramos and as many as 20 Yonkers employees were denied overtime. I note the suit seeks damages, attorney’s fees, and unpaid wages on behalf of Cheesecake Factory employees who worked at any New York location over the last six years (potentially affecting up to about 100 people), that the plaintiffs’ lawyer estimates damages could go into eight digits, and that the Cheesecake Factory declined to comment; I also reference the company’s prior 2018 California labor enforcement action requiring a $4.5 million payment related to subcontracted janitorial wage violations." - Luke Fortney
